3 Jumbo Mistakes Property Owners Commonly Make with Insurance Claims


Jumbo Mistake #1 - Not Filing an Insurance Claim when you should Missing Shingles

Most people have insurance policies to protect themselves should something go wrong, then when something does, they’re afraid to use it!

That sounds crazy at first. You have insurance. Something went wrong. Why not use it?

The fear is that by making a claim, rates will go up or you will be cancelled. That is possible if you have too many claims for incidents that are within your control (such as a sink overflowing), but not for naturally occurring incidents like a roof insurance claim.

Insurance property claims made in response to a naturally occurring incidents, or “Acts of God,” CANNOT result in an increase in premiums, cancellation, or non-renewal!

“Acts of God” are claims that are a result of a wind storm, hurricane, hail damage, or tornado and are beyond your control. Therefore, you are not punished for making a claim due to their damage.

Jumbo Mistake #2 - Filing a Frivolous Insurance Claim

Property casualty insurance (whether residential or commercial) is for significant events like a fire, hail or wind storm, or a fallen tree on your home or business – not for minor expenses like the theft of a bicycle or a single broken window. So, while filing an insurance property claim may be valid, it may not always be wise to file it.

For example, take a look at your insurance policy and read the declaration pages (yes, I know it's boring!). Most insurance policies contain a 1% or 2% deductible requirement. The amount of the insurance claim needs to be considerably more than the deductible to make it worth making the claim.

So how do you know if you have enough damage to make a claim?

  • dents or damage in siding?
  • dents or damage to decking, fences, pergola's, etc.?

  • Jumbo Mistake # 3 - Not paying your insurance policy required deductible

    Not paying your required insurance deductible is probably the most common mistake property owners make – often without knowing the consequences. Storm chasers and shady roofers may promise to put on your roof for whatever insurance pays. While the thought of a “free roof” sounds great, failing to pay your insurance deductible is illegal in Texas and going along with this scheme means you may be committing insurance fraud!

    Don't be fooled by a roofer and allow them to convince you that they can get around this requirement by paying you an “advertising fee” for putting a sign in your yard. Or they will conveniently forget to collect the final payment at the end of the job.

    Regardless of how these scammers try and rationalize it, not paying your insurance policy deductible is a serious breech of contract and may constitute insurance fraud! Insurance fraud costs consumers and average of almost $700 per family in additional premiums per year. But more importantly, insurance fraud carries a penalty up to $10,000 and up to 2 years in state prison, depending on the dollar value of the fraudulent claim. Please reference Tex.
